Chiu v. Canada (Attorney General)

- Parties: The applicant was Brian Chiu. The respondent was the Attorney General of Canada. 

- Subject Matter: The applicant sought judicial review of a Canada Revenue Agency (CRA) decision finding him ineligible to receive the Canada Recovery Benefit (CRB), which provided financial support to employed and self-employed Canadians who were directly affected by the COVID-19 pandemic and who were not entitled to receive employment Insurance (EI) benefits. 

- Ruling: The court ruled in the applicant’s favour, allowed the judicial review application, and remitted the matter to a different CRA reviewer for redetermination. The court held that the applicant did not receive specific reasons for why his income did not meet the eligibility criteria for the CRB. While the reviewer’s notes indicated a concern about when the applicant earned T4 income in 2020, this concern was never conveyed to the applicant. The court could not say whether a redetermination of the applicant’s CRB eligibility would result in a favourable decision. The court saw insufficient evidence to permit such an assessment or to suggest any particular urgency in this matter. The court accepted that the applicant was understandably frustrated about the number of times that his case was reviewed but noted that his inability to timely produce relevant documents contributed to the delays so far encountered.
