Background and parties

Jean-Maurice Bellaiche, admitted to the Barreau in 1980 and practicing in civil and commercial litigation, was retained by Géo Tours Inc., a company operating in group tourism from Europe to Canada and the United States. The individual defendants, Véronique Magallon Fettaya and Claude Chalom Fettaya, were involved in the management of Géo Tours Inc., with Mr. Fettaya as the principal shareholder and administrator, and Mrs. Fettaya actively involved in company activities.

Mandate and dispute

In September 2018, Géo Tours Inc. gave Bellaiche a mandate to recover sums allegedly misappropriated by former employee France Villeneuve, as well as damages and interest. The mandate terms changed several times: initially hourly, then a percentage of recovery, and finally an hourly rate with a maximum budget of $42,000. Bellaiche claimed $46,225.39 in unpaid fees and $18,000 in moral damages. The defendants argued the fees were exaggerated and unjustified, and that the individual defendants had no personal responsibility for payment. They also alleged that Bellaiche’s conduct was abusive and sought compensation for their own legal fees and moral damages.

Bellaiche was ordered to pay Géo Tours Inc. $6,225.00 for abuse of procedure, and $1,000 each to Véronique Magallon Fettaya and Claude Chalom Fettaya as moral damages, all with interest from the date of judgment and the additional indemnity. The court ordered compensation between the sums owed, and each party was to bear its own legal costs.

Conclusion
