Charles Arthur Wesley et al. v. His Majesty the King

- Parties: The plaintiffs were Charles Arthur Wesley, Christopher Robert Wesley, Sharon Nicholas, and Nicole Eileen Nicholas. The defendant was His Majesty the King.

- Subject Matter: This Federal Court proposed class proceeding involves a claim for damages brought by four Indigenous plaintiffs against His Majesty the King, alleging that the current registration provisions of the Indian Act (particularly sections 6(1)(d), 6(1)(f), and 6(2)) are clearly unconstitutional insofar as they deny the Plaintiffs and class members the benefits of registration because of a family history of enfranchisement, in violation of section 15 of the Charter, section 35 of the Constitution Act, 1982, Crown fiduciary duties, and the honour of the Crown. The Plaintiffs seek certification of the action as a class proceeding on behalf of two proposed subclasses, and the Defendant has filed a Motion to Strike portions of the Second Amended Statement of Claim as well as a Sequencing Motion. The case is ongoing.

- Date: The hearing was set on March 24, 2026.

- Venue: This was a federal case before the Federal Court.

- Amount: No financial award was specified.
