Murphy v. Canada

The appeal motion challenging Associate Justice Tabib's decision to strike the judicial review application has been dismissed. The issue revolved around whether Tabib made an error in granting the motion to strike. The Federal Public Sector Labour Relations Act, which grants employees the right to grieve, was discussed. Additional evidence was filed by Ms. Murphy, but it was deemed inadmissible due to lack of exceptional circumstances. Tabib's determination regarding exceptional circumstances was upheld, and the court found no errors in her analysis. The appeal was dismissed, and costs in the amount of $750.00 were awarded to the respondent.
