Pereira v. British Columbia (Attorney General)

Corinne Pereira sought certiorari and mandamus to challenge the decision of the Attorney General of British Columbia (AGBC) to stay the proceedings of a private information she had filed. The private information was related to previous complaints she had made against her former employer, union, and various individuals. The applicant had previously filed similar private informations, which had also been stayed by Crown counsel. Justice Tammen dismissed her application, stating that there was no abuse of process or flagrant impropriety by the AGBC. The Court of Appeal upheld this decision and rejected the applicant's request to introduce fresh evidence. The applicant then relied on a review officer's decision related to her workplace complaints, but the court concluded that it did not establish abuse of process. The court affirmed that prosecutorial discretion was exercised in good faith and dismissed the application.
