In the case of Dediu v Martin Estate dated May 19, 2023, the plaintiff, Michael Dediu, alleged that trading accounts registered under the deceased, Douglas Martin, were held in trust for the plaintiff. They sought a declaration confirming this trust and damages for breach of trust, including losses incurred when the defendant sold the trust assets without consent. The defendant, Sandra Ann Martin, as Executor and Trustee of the Estate of Douglas Warren Martin, denied the existence of any trust, both in fact and in law. The court concluded that the plaintiff was declared as the beneficial owner. Furthermore, the plaintiff was awarded damages against the defendant in the amount of C$2,568,075. Regarding costs, the plaintiff was entitled to their costs of this action, at Scale B, unless there were any further submissions from the parties on the matter.
