Smeets Law Corporation v. Abbott Estate
Smeets Law Corporation filed a claim against Mary Jean Abbott's estate seeking recovery. Ms. Abbott had entered into a contingency fee agreement with the Law Firm on March 26, 2014. Unfortunately, Ms. Abbott passed away on July 2, 2019. The Law Firm had represented her from November 2013 to September 2019 in a claim against the Vancouver International Airport and a health care claim. In 2019, Ms. Abbott fell seriously ill and decided to pursue medical assistance in dying. Her lawyer, Mr. Smeets, initiated negotiations for the discontinuance of her claim on June 24, 2019. Ms. Abbott also requested the preparation of the Law Firm's final account, which amounted to $37,201.94, plus interest. Despite presenting the account to her before her death on July 2, 2019, it remained unpaid. The executor of her estate, David Dickinson, has since refused to pay, arguing that the legal fees were not properly payable. The total amount due, including interest, is $61,125.34, which remains unpaid as of the trial.
