Chavez-Salinas v. Tower
The plaintiff, Delia L. Chavez-Salinas, was injured in a motor vehicle collision and sued the defendant, Kenneth Tower, for damages. The court found the defendant 80% liable and the plaintiff 20% liable for the collision. The plaintiff was initially awarded costs but later appealed. On appeal, the finding of contributory negligence was set aside and the plaintiff's cost of care award was reduced. Ultimately, the plaintiff was awarded $390,750 in damages, significantly less than the initial claim. The plaintiff sought a costs order on scale C, but the court determined that the case was of ordinary difficulty and awarded costs at scale B instead. The plaintiff's application for costs at scale C was denied.
