McMahon v. Sovdat
In a car accident trial that occurred in November 2022, liability was admitted but damages, including past and future income loss, were strongly contested. The jury awarded $500,330 in total damages, including non-pecuniary damages, past income loss, future income loss, costs of future care, and special damages. The court granted the defendant's application for deductions related to special damages and section 83, with $16,752 deducted from special damages and $50,000 deducted from the cost of future care, which were covered by ICBC's Part 7 benefits. The defendant's application for trial costs was dismissed, and the plaintiff was entitled to her ordinary costs and disbursements. The parties bore their own costs for the combined applications.
