Lacey v Petrovic
The plaintiff had a motor vehicle accident on June 12, 2018, resulting in knee injuries. Liability was admitted by the defendants, and there was agreement on past income loss and special damages. The main issues revolved around non-pecuniary damages, future loss of income capacity, loss of housekeeping, and cost of future care. Expert witnesses, Dr. Kei and Dr. Rickards, held differing opinions. The defense expert recommended additional treatment, including surgery, and presented evidence of future capacity losses. The defendants were found liable for the accident and the plaintiff's injuries. The awarded amounts were: $90,000 for non-pecuniary damages, $2,877.05 for past income loss, $20,000 for future loss of capacity to earn income, $2,500 for future cost of care, $7,500 for future loss of housekeeping capacity, and $4,773.60 for special damages. The total award reached $127,650.65. Unless there are undisclosed offers, the plaintiff is entitled to her costs.
