Finley v Choi
Plaintiff Ian Finley had been involved in a motor vehicle accident in Surrey, BC. He had been hit from behind while waiting to turn left. The defendants, Gyu C. Choi and Yun Ha, had admitted liability, and the only issue had been the assessment of damages. Prior to the accident, Finley had been active and had worked as a carpenter in the UK. He had immigrated to Canada with his family to work on a construction project. Finley had described himself as fit and healthy before the accident. After the collision, he had experienced neck, shoulder, and back pain and had sought various treatments for relief, including injections. The court had awarded a total amount of $360,304.13 for the payment of non-pecuniary damages, past loss of earnings, future loss of earning capacity, future care, loss of housekeeping capacity valued, and special damages.
