Cyr v Randhawa
Reginald Cyr, a 50-year-old pharmacy assistant, was injured in two motor vehicle accidents. Liability was admitted, and Cyr sought damages for his accident-related injuries. He had pre-existing health conditions that complicated the assessment of damages. Cyr had been active in his youth but was overweight. He had worked his way up as a pharmacy assistant and had three children. Prior to the accidents, he had experienced knee pain and had taken antidepressants for anger management. The first accident caused stiffness and worsened pain, leading to treatments and accommodations at work. The second accident aggravated his lower back pain, which persisted despite ongoing treatments. Cyr also suffered from knee pain and needed to lose weight to be eligible for knee replacement surgery. The court ordered the defendants to pay Cyr the following damages: Non-Pecuniary Damages: $120,000.00, Past Loss of Income Earning Capacity: $24,000.00, Future Loss of Income Earning Capacity: $280,000.00, Cost of Future Care: $14,881.00, Loss of Housekeeping capacity: $50,000.00, and Special Damages: $5,487.87.
