Langara Gardens Holdings Ltd. v Chen
On November 14, 2017, a fire broke out in unit 603 of Building 1 at Langara Gardens, a rental apartment complex in Vancouver. The owners, Langara Gardens Holdings Ltd., accused Angela Chou of negligently causing the fire and sought damages for repairs and lost rental revenue. Unit 603 was rented by Danny Chen and Angela Chou, who occupied it with their children during the incident. The court found Angela Chou liable for the fire damage to her unit and the building. Langara Gardens was not considered contributorily negligent. The total damages awarded amounted to $568,995.49, including repair costs, restoration expenses, and lost rental revenue. Both Chou and Chen were held responsible for the restoration and repair costs, excluding lost rent. Langara Gardens was granted pre-judgment interest and costs at scale B.
