Luisa McHugh sought judicial review of the Workers' Compensation Appeal Tribunal's decision, which had denied her claim for benefits from the Workers' Compensation Board. She argued that her workplace activities at ICBC had caused or contributed to her arm conditions, but her claim was rejected by both the Board and the Tribunal. The court has now challenged the Tribunal's decision based on an inadequate workplace evaluation, disregard for an expert's report, and a mistaken finding on repetitive forearm movements. The court deemed the workplace evaluation unreliable, found the Tribunal's preference for one expert over another irrational, and ordered reconsideration based on these findings.
