Gai Cadrin sued Dunsmuir Holdings for wrongful dismissal after being terminated from her 35-year employment at the Jolly Miller Pub and Liquor Store. She sought damages for pay in lieu of notice, as well as aggravated and punitive damages. The strained relationship between Cadrin and co-manager Heather Peterson had led to escalating tensions and conflicts. Cadrin had been upset by the lack of prior notice regarding Peterson's promotion. The working environment had deteriorated, causing stress for Cadrin. Despite attempts to resolve the issue through mediation and discussions about layoffs and unemployment insurance, no satisfactory resolution had been reached. The court awarded plaintiff damages for 17 months of notice, including various compensation and benefits, minus the eight weeks already paid. The claims for aggravated and punitive damages were rejected. Parties could submit written arguments on costs within 14 days.
