Equustek Solutions Inc. v Jack
Google sought access to the trial file and exhibits in a case where it was not a party. The application was opposed by Equustek Solutions Inc., Robert Angus, and Clarma Enterprises Ltd. The plaintiffs had successfully won their trial against the defendants who had stolen trade secrets and used Google's indexing to market their products online. Google appealed the interim injunction, but it was upheld. Now, Google requested access to the trial evidence before responding further to the plaintiffs' application for a permanent injunction. The court granted Google access to the trial record and exhibits under an undertaking and declined to hear an application for procedural directions.
