Chin v 0880984 B.C. Ltd.
The action arose from an incident at the premises of the defendant 0880984 B.C. Ltd. dba MCL Motor Cars 2010 (“MCL”) on February 7, 2018, in which the plaintiff, Hedy Chin, fell onto the concrete floor of MCL’s automotive shop, injuring herself. The plaintiff, Hedy Chin, had visited MCL's service center to repair her Range Rover. After entering the reception area and speaking with Jackie Lai, they proceeded to the shop area. They walked along a dark grey walkway with a wall on their left, leading to a light grey driveline where the vehicle had been parked. While returning to the reception area, Ms. Chin fell and was assisted by Mr. Lai and Ron Laing. MCL's employees moved her to the lunchroom, called an ambulance, and she spent over 10 hours in the hospital before being driven home by her family. The court concluded that Ms. Chin fell due to a hazard in the MCL shop. MCL had lacked a reasonable cleaning system in place on the day of the incident and had failed to take other preventative measures, such as closely supervising Ms. Chin or displaying warning signs. As a result, MCL was held responsible for the damages suffered by Ms. Chin. The quantification of damages would be determined in a subsequent proceeding, and the issue of costs would be addressed thereafter.
