Adams v Fillion
The plaintiff, Rebeca Adams, sustained injuries in a motor vehicle accident on October 26, 2016, and seven weeks later, she experienced a brain hemorrhage, resulting in severe neurological deficits. The main issue in this case was whether the accident had caused the hemorrhage. The plaintiff sought a declaration that a summary trial was not suitable for determining causation. The defendants, Claude Fillion and Suzanne Fillion, argued that a summary trial would have been appropriate and could have saved costs and time. However, the court found the causation issue to be complex, necessitating credibility assessments and extensive cross-examination of experts. Consequently, the court ruled that a summary trial was not suitable and adjourned the trial. The defendants were ordered to pay the costs of the application. No specific information regarding a financial award was provided in the case.
