In the case of Ahluwalia v Workers’ Compensation Board of British Columbia, which was dated February 9, 2023, petitioner Mr. Ahluwalia sought a judicial review of decisions made by the respondent Workers' Compensation Board of British Columbia regarding his injury on a job site. He argued that the Board had acted unreasonably by considering working as a paralegal as a reasonable occupational goal for him and by terminating his job search assistance and benefits before he had found such a position. The Board maintained that it had acted reasonably and that some of the relief Mr. Ahluwalia sought might not be available through this review. Initially, the hearing had been scheduled for July 2021, but it had been adjourned to allow Mr. Ahluwalia to file an amended petition addressing the issues of unreasonableness and procedural unfairness. The court dismissed the petition and encouraged Mr. Ahluwalia to fully document any decline in his function or new effects of his injury and to provide the necessary information if he wished to pursue a legal career or become a notary. No costs were awarded in this case.
