In the case of 77 Veterinary Holdings Ltd. v Maricle dated July 13, 2023, the plaintiff, 77 Veterinary Holdings Ltd., sought summary judgment for specific performance of an option to purchase a commercial property in Kamloops, BC. The property included the location of Valleyview Veterinary Clinic. The defendants, Bruce Victor Maricle and Jean Carla Tobey, were former owners of the clinic and also owned the property. As part of the transaction, the plaintiff leased the property with the option to purchase it. The dispute centered around a General Electric CT Scanner owned by the defendants, and whether it was part of the property the plaintiff must purchase. The plaintiff argued that it did not want the scanner and that it had little to no value. However, the court found that the option was still valid, and the scanner was considered a fixture and part of the property. Despite this, the court determined that the scanner had no value. Thus, the plaintiff could proceed to purchase the property as per the terms of the option.
