Loy v. Richard K. Watson Professional Corporation
In the case Loy v. Richard K. Watson Professional Corporation dated July 14, 2023, the plaintiffs, Sarina Loy, Kelsey Ng, and Eli-Pharm Inc, who were mortgagees, sought judgment against the defendants, Richard K. Watson Professional Corporation and Richard K. Watson, a professional legal corporation, and its principal, for breach of contract and solicitor negligence. The defendants, who were the mortgagor and guarantor, respectively, had entered into minutes of settlement, agreeing to extend the mortgage in exchange for executing a consent to judgment if the mortgage was not paid out. The defendants had failed to pay out the mortgage in accordance with the minutes of settlement, leading to the plaintiffs commencing an action. The parties had agreed again to extend the mortgage, but once more, the defendants did not pay out the mortgage. The plaintiffs had sought default judgment. The court had ordered judgment in favor of the plaintiffs for $307,735, with an additional $6,000 as a consulting fee, and had granted them a writ of possession. The defendants were also required to pay interest at 8.5% after May 1, 2023, and the plaintiffs were awarded costs of $1,500 for fees and $904 for disbursements.
