Song v Yongfeng Enterprises Inc.
In the case of Song v Yongfeng Enterprises Inc. dated July 18, 2023, it involved defendant Yongfeng Enterprises Ltd., defendant by counterclaim Michelle Wei, and plaintiffs Yu Na Song and Bo Wei, concerning the construction of two houses in West Vancouver and Richmond, British Columbia.
In West Vancouver, the construction proceeded according to a signed building agreement between Michelle Wei and Yongfeng, but disputes arose towards the end of the project. Yongfeng claimed that Ms. Wei owed $273,000 for unpaid amounts and extras, while Ms. Wei contested these claims and sought set-off for alleged deficiencies and delays caused by Yongfeng.
Regarding the Richmond house, there was no signed building agreement, leading to disagreements about the verbal agreements. Yongfeng completed some construction work, obtaining municipal approvals for rough-in systems, but Mr. Wei and Ms. Song instructed them to stop and leave the property. Yongfeng claimed $1.5 million for unpaid work and lost profits, while Ms. Song and Mr. Wei counterclaimed for $207,000 of alleged overpayments and deficiencies.
In the end, the court awarded Yongfeng damages of $239,834 from Ms. Wei for the West Vancouver house construction and damages of $1,154,150 from Mr. Wei for the Richmond house construction. Additionally, Ms. Ren was awarded $2,500 from Ms. Song and Mr. Wei for abuse of process.
