Arvan Rehab Group Inc. v. Millea et al.

In the case of Arvan Rehab Group Inc. v. Millea et al. dated July 20, 2023, the plaintiff, Arvan Rehab Group ("Arvan"), had filed a lawsuit against the defendant, Roderick Millea ("Millea"), and his company, Millea Physiotherapy Professional Corporation ("MPPC"). Arvan alleged that Millea had breached their contract and his fiduciary duty to Arvan. The dispute had arisen when the Government of Ontario changed the funding model for physiotherapy services in long-term care facilities. Consequently, Norview Lodge ("Norview"), one of Arvan's clients, had issued a Request for Proposal ("RFP") for physiotherapy services. Both Arvan and Millea had submitted bids for the RFP. Ultimately, Millea had won the bid, leading Arvan to claim that Millea's involvement had prevented them from winning, and they sought compensation for his alleged breach of contract. The court had determined that the 2007 Contract between Arvan and Millea had been valid and enforceable, and Millea's actions had indeed breached the non-solicitation provisions contained in that contract. The action against Nicole Tweedie and Rachel Erauw had been dismissed before the trial. As of the court's ruling, Arvan's case against Millea and MPPC had remained in pursuit of damages to recover their lost contract with Norfolk County or disgorgement of profits from the bid that Arvan believed the defendants had wrongfully secured. The trial had highlighted the changes to the funding model that had affected the bidding process and had ultimately led to the legal dispute between the parties. No specific amount provided in the case regarding financial award.
