Toronto Transit Commission v Spaeth et al.

In the case of Toronto Transit Commission v Spaeth et al. dated June 19, 2023, involved two legal actions. In one action, Toronto Transit Commission (TTC) was the plaintiff and sued defendants Ronald Howard Spaeth, Specbilt Enterprises Inc., and Michael Hickey. Mr. Hickey, a former TTC employee, was accused of participating in a scheme to manipulate TTC's materials and procurement process with Specbilt, a company in which he had an interest. TTC alleged that Hickey recommended Specbilt and Prostuff Group (represented by Mr. Spaeth) as vendors for automotive parts and supplies to TTC without disclosing the conflict of interest. TTC sought damages related to the purchase of approximately $2 million worth of parts and supplies based on Hickey's recommendations. In the other action, Mr. Hickey was the plaintiff and claimed wrongful dismissal, seeking relief for his termination by TTC. Both parties conducted examinations for discovery and brought motions to compel answers to questions that were refused. An Associate Justice Jolly released one decision for all the motions. TTC appealed this decision, but they confirmed they were not pursuing the appeal concerning questions asked of Mr. Hickey during his examination for discovery. The appeal was partially allowed. The court requested counsel to collaborate and submit an approved order that aligned with the court's decision. The court encouraged both parties to come to an agreement regarding the issue of costs.
