George v Alemu
In the case of Diane George (Plaintiff) v Netsanet Alemu, Wondwossen Assalahun, RBC General Insurance Company, and Aviva General Insurance Company (Defendants), the court heard the matter on June 8, 2023. The action had been initiated under the simplified procedure of Rule 76 of the Rules of Civil Procedure. RBC General Insurance Company and Aviva General Insurance Company had served a jury notice in July 2018, and the action was set down for trial. Ms. George had sought an order to strike the jury notice, along with leave under r. 48.04(1) to bring the motion. However, the court had denied her leave application and also stated that even if it had been granted, the jury notice would not have been struck, and the matter would have proceeded under the ordinary procedure. The case had stemmed from a motor vehicle accident that occurred on July 19, 2014, and the action had been initially commenced on July 13, 2016, under the simplified procedure. Examinations for discovery had been completed in October 2018, and mediation had been conducted in May 2019. Subsequently, Ms. George had sought trial dates, which had been initially scheduled for March 13, 2023, but later moved to the week of June 14, 2023. The court had held that Ms. George's motion was dismissed, and the matter would continue under the ordinary procedure. As the successful parties, RBC and Aviva had been presumptively entitled to their costs of the motion, and if the parties couldn't agree on costs, they had been given a specific timetable to provide written submissions for consideration.
