Gidda v Intact Insurance Company
The case of Gidda v Intact Insurance Company dated May 12, 2023, was a court application for approval of a settlement in a statutory accident benefit claim for applicant Mr. Mehtab Singh Gidda, who was under disability, represented by his mother Sukhdev Gidda. The application was made under r. 7.08 of the Rules of Civil Procedure for court approval of a settlement reached by Neinstein LLP on behalf of Mr. Gidda. The settlement involved a sum of $735,000 for accident benefits. The court was asked to approve the settlement and Neinstein LLP's legal fees based on a Contingency Fee Agreement. Mr. Gidda had suffered severe injuries in a motor vehicle accident in 2018, resulting in catastrophic impairment. Despite being eligible for substantial coverage, he had never received these benefits due to his condition. The court had previously identified gaps in information, which had been addressed by Mr. Neinstein. The accident had drastically changed Mr. Gidda's life, causing traumatic brain injuries and rendering him non-verbal and bedridden. His family had been providing constant care, and he had required substantial medical attention. The court had been satisfied that the settlement was fair, reasonable, and in Mr. Gidda's best interest, given the severity of his injuries and the applicable benefits. The court had acknowledged that the settlement had encompassed all potential claims for past and future statutory accident benefits available to Mr. Gidda.
