In the case of McKenzie et al v. The Block et al dated April 21, 2023, plaintiffs Patricia Althea McKenzie and Richard D.P. Allen jointly purchased a condominium unit known as Suite G-311, 275 Larch Street, in Waterloo from defendant The Block, Inc. The purchase had been made through an agreement of purchase and sale for $362,999, with a total deposit of $54,449.90 held in trust by Sorbara, who acted as escrow agents and lawyers for The Block. Initially, the plaintiffs had entered a lease-back program with The Block, wherein they received a rental guarantee fee while paying monthly occupancy fees. The plaintiffs had terminated the agreement on August 27, 2021, without knowledge of The Block's declaration registration. The Block had disagreed with this termination and had demanded title transfer on September 15, 2021. A dispute had ensued, with The Block claiming that the Applicants had breached the agreement, thereby forfeiting their deposit, and subsequently selling the property for $500,000. Ultimately, the case had centered on whether the plaintiffs had validly terminated the purchase agreement and whether they were entitled to the return of their deposit The court had held that the plaintiffs' arguments had been insufficient to support their case. Regarding costs, the parties had been encouraged to come to a mutual agreement on the matter. In case they had not reached an agreement, the court had been open to considering cost submissions.
