PC Forge v. BRC Motorsports Inc.
In the case of PC Forge v. BRC Motorsports Inc. dated April 12, 2023, the plaintiff, PC Forge ("PC"), a manufacturer of custom forgings for the oil and gas industry, initiated legal proceedings against the defendant, BRC Motorsport Inc. ("BRC"), a company formerly involved in supplying parts for the oil and gas sector. The dispute revolved around a contract they had entered into for the supply of forgings. PC had required a lead time of 18 to 20 weeks to fulfill orders, while BRC had sought a reduced lead time of 1 to 4 weeks.
PC had brought a lawsuit for breach of contract, seeking summary judgment. The court had found in favor of PC, rejecting BRC's claims of ambiguity in their agreement. The court had accepted PC's evidence, including affidavits and documentation. It had been determined that BRC had breached the contract by failing to take delivery of and pay for completed forgings totaling $214,587.24. PC's mitigation efforts, including selling some of the forgings and repurposing raw materials, had been considered adequate. Consequently, the court had awarded PC damages in the amount of $205,907.24, along with pre- and post-judgment interest as per legal provisions. BRC's claims of alleged concealment and assertions of PC's lack of credibility had not been accepted by the court, and no genuine issues had been found that warranted a trial.
