In the case of Nelco Mechanical Limited v. 2335213 Ontario Inc. dated March 6, 2023, the plaintiff, Nelco Mechanical Limited, filed a motion seeking an order to impose a discovery plan and compel the defendants, 2335213 Ontario Inc. and Pardeep Kumar Bhopal, to produce specific corporate and financial documents. 233 Inc. owned a property where a hotel project was constructed, beginning in 2017 and completing around August 2020. Mr. Bhopal appeared to be the sole officer and director of 233 Inc., as per the corporate profile report. Nelco, engaged in mechanical contracting, entered into a contract with 233 Inc. to supply materials and labor for plumbing in the hotel project. Nelco also provided financing to the Defendants. The Plaintiff invoiced 233 Inc. for materials and services, totaling $277,652.90, but alleged that the invoices were not paid. The Plaintiff initiated a legal action against the Defendants in February 2022, seeking payment. The Court analyzed the relevance and proportionality of these documents and issued rulings. It found certain documents relevant, such as certificates of payment and bank statements, ordering their production.
