Bolduc v. Legault
In the case of Bolduc v. Legault dated March 28, 2023, plaintiff Stacey Bolduc had purchased the property at 3044 Menard Street, Greater Sudbury, from defendant Randy Legault. A few months later, moisture issues had emerged in the basement, leading to structural damage in the foundation due to weakened cement blocks and mortar. The Bolducs had claimed that remedying the water and foundation damage would cost over $400,000, alleging breach of contract and negligent misrepresentation by Legault. Legault had denied any knowledge of the problems and had disputed the claimed damages. As such, damages had been reduced to account for the lack of timely action. Ultimately, the court had assessed the potential damages at $104,000 (including foundation repair and lost rent), emphasizing that early remediation could have reduced stress and financial strain. No punitive or aggravated damages had been awarded, and the court had found Legault not liable for the claimed losses.
