Austin v Glass
In the case of Austin v Glass dated August 25, 2023, the plaintiff, Jack Craig Austin, had been driving on the Alex Fraser Bridge in Delta, BC when he was rear-ended by the defendant, Sandra Jane Glass, in an incident known as the "Accident." The defendant had accepted responsibility for the collision. Before the Accident, Mr. Austin had had a history of semi-professional hockey in Germany for four years, but in 2016, he had suffered a severe hockey-related injury (the "2016 Hockey Accident"). Prior to the Accident, he had had a physically demanding full-time job and had regularly engaged in recreational hockey. The Accident had aggravated his pre-existing pain and concussion symptoms and had resulted in various psychological injuries. Following the Accident, on March 10, 2020, Mr. Austin had experienced another life-altering event—a significant workplace accident (the "2020 Workplace Accident") that had permanently prevented him from working. Ultimately, the court had found in favor of Mr. Austin and had awarded him the requested damages, including compensation for pain and suffering, income loss, future care, and special damages, amounting to a total of $458,756.
