Burr v Sharma
In the case of Burr v. Sharma, dated September 5, 2023, the plaintiff, Jody Burr, had been driving home from work when her SUV was rear-ended by a vehicle owned by Ashok Sharma and driven by Dave Sharma (the "Defendants"). The accident had resulted in extensive damage to several vehicles, and Jody Burr had sustained multiple injuries, including a mild traumatic brain injury, chronic pain, post-traumatic stress disorder, depression, and various physical ailments. Before the accident, Jody Burr had been an office manager, involved in a long-term relationship with Darrell Unger, and enjoying an active lifestyle that included outdoor activities such as skiing, hiking, and golfing. However, following the accident, Jody's life had undergone significant changes. She had experienced ongoing pain, dizziness, and psychological issues, all of which had limited her ability to participate in her previous activities. She had become dependent on others for transportation, and financial management. Moreover, her capacity to work had been severely impaired, and she had struggled with memory and focus. The court had awarded Jody Burr a total of $1,840,810.92 in damages. This amount had included $215,000 for non-pecuniary damages, $509,000 for past loss of earning capacity, $875,000 for future loss of earning capacity, $65,493 for the cost of future care, $150,000 for past and future loss of housekeeping capacity, $10,000 in an in-trust claim, and $16,317.92 in special damages. The plaintiff had been considered substantially successful, and the court had granted costs, unless the Defendants had submitted further arguments within 30 days.
