Switzer et al. v. Petrie et al.
In the case of Switzer et al. v. Petrie et al. dated September 11, 2023, the plaintiffs, Lloyd Switzer and Violet June Switzer, and defendants Scott Petrie and Kathleen Petrie had entered into a Purchase and Sale Agreement (APS) for a residential property owned by the plaintiffs. The purchase price was set at $810,000, and the closing date was scheduled for July 14, 2022. The defendants had provided a $15,000 deposit. However, the defendants informed the plaintiffs that they would not proceed with the sale due to unforeseen consequences. In response, the plaintiffs relisted the property for sale on July 5, 2022, at a reduced price of $699,900. Subsequently, the plaintiffs initiated legal action to seek compensation for the difference between the agreed purchase price and the amount they received from the resale, as well as various fees totaling $2,302.11. This added up to a total claim of $212,302.11. The court ultimately granted summary judgment in favor of the plaintiffs. It determined that the fair market value of the property at the time of resale had been $600,000, and therefore, the plaintiffs were entitled to damages amounting to $212,302.11. The court also permitted the plaintiffs to retain the $15,000 deposit as a credit against the judgment. Regarding the matters of pre-judgment interest and costs, these were deferred for further submissions or negotiation between the parties, with the court encouraging an amicable resolution.
