Richmond Inn Hotel Ltd. v Unite Here Local 40
In the case of Richmond Inn Hotel Ltd. v Unite Here Local 40 dated September 1, 2023, the plaintiffs, Richmond Inn Hotel Ltd. et al., who had owned and operated several hotels near the Richmond airport in British Columbia, had found themselves entangled in a labor dispute with certain employees represented by the defendant, Unite Here Local 40, referred to as "the Union." This dispute had led to a strike by the employees since June 14, 2023, with the Union supporting picketing activities around the affected hotels.
The application had been heard by Kent J. on August 2, 2023, resulting in a mutually agreed-upon order known as the "Injunction." The Injunction had outlined restrictions, including bans on using sirens, air horns, blow horns, whistles, drums, microphones, speakers, and electronic devices producing sounds exceeding 75dBA, as defined by the City of Richmond Bylaw No. 8856.
Allegedly, the Union, including its Vice President Gulzar Grewal, collectively referred to as "the Respondents," had failed to comply with these terms. They had been accused of breaching the Injunction by generating noise levels exceeding 75 dBA on various dates using instruments like drums, megaphones, hand-clappers, and whistles.
In response, the plaintiffs had sought orders to hold the Respondents in contempt of court, compel them to cease their conduct violating the Injunction, and add a police enforcement clause to the Injunction.
However, the court had ultimately refused the plaintiffs' application for these orders.
