Andrade v. Collins
In the case of Andrade v. Collins dated October 25, 2023, the plaintiffs, Yvette Kramer and Garry Andrade, referred to as "Yvette and Garry," had purchased the Rock Pine Motel and Restaurant in Marten River, Ontario, from the defendants, Johnson and Rosellee Collins, known as "John and Rose." The Rock Pine consisted of a motel, restaurant, and gas station situated on Frenchman's Bay. The dispute had stemmed from John's alleged misrepresentations to Yvette and Garry, where he claimed that the Rock Pine's tank system was in good condition, needing only spring testing. Yvette and Garry had asserted that these statements were fraudulent and negligent, influencing their decision to buy the property. As per the Agreement of Purchase and Sale, John and Rose were obligated to obtain a report confirming the tank system's safety and compliance. However, Yvette and Garry had claimed they never received this report, leading to a breach of the agreement. Following the trial, it had been determined that the plaintiffs were entitled to damages totaling $635,189.12, broken down into various expenses, including the installation of an underground fuel tank system, re-paving, and more. The court had addressed the issue of costs, stipulating a process for the parties to agree on or dispute the allocation of legal expenses within a specified timeframe.
