Trainor v DeArcos

- Parties: The plaintiff was Meghan Trainor. The defendant was Sebastien DeArcos. 

- Subject Matter: The plaintiff, who was involved in a motor vehicle accident, sought compensation. The issue in this case was whether the accident altered the trajectory of her life. Other issues were whether the accident caused her injuries, whether it engaged legal entitlement to indemnification, and, if yes, how much damages flowed from the injuries. 

- Ruling: The court ruled in the plaintiff’s favour and awarded her the amount of $324,888.65. This compensation consisted of general damages of $150,000 plus special damages, comprising $20,929.11 in past loss of housekeeping capacity, $53,959.54 in future cost of care, and $100,000 in past loss of earnings. The court held that the evidence established that the accident caused her injuries. The court said that her chronic pain, tempo mandibular disorder, and additional surgeries to her right leg to address the femoral derotational osteotomy were not reasonably foreseeable consequences of the accident and were too remote within the causation at law analysis to warrant recovery. The court saw no reason to doubt that she suffered chronic pain stemming from pre-existing psychiatric conditions and not caused by the accident.
