Emilio Zavarella v. Attorney General of Canada

- Parties: The applicant was Emilio Zavarella. The respondent was the Attorney General of Canada.

- Subject Matter: On July 5, 2021, the applicant filed a complaint alleging that respondent Immigration, Refugees and Citizenship Canada discriminated based on the applicant's disability under ss. 7 and 10 of the Canadian Human Rights Act, 1985. The complaint alleged that the respondent acted in a discriminatory manner after the applicant disclosed their disability during a selection process for a foreign service officer position by providing the applicant with false or misleading information that discouraged and prevented them from accepting the offer. This judicial review application challenged a Canadian Human Rights Commission decision. The decision dismissed the applicant's complaint under s. 44(3)(b)(i) of the Canadian Human Rights Act and refused to refer the complaint to the Canadian Human Rights Tribunal while allegedly failing to address the complaint's essence and key allegations in a reasonable and procedurally fair manner. This case is ongoing.

- Date: The hearing was set on Mar. 19, 2025.

- Venue: This was a federal case before the Federal Court.

- Amount: No financial award was specified.
