Motion Picture Association-Canada et al. v. Canadian Association of Broadcasters

- Parties: The appellants were Motion Picture Association-Canada (MPAC); Crunchyroll, LLC; Netflix Services Canada ULC; Paramount Entertainment Canada ULC; and Pluto Inc. The respondent was the Canadian Association of Broadcasters (CAB). 

- Subject Matter: The Canadian Radio-television and Telecommunications Commission (CRTC) implemented certain amendments made by the Online Streaming Act, 2023 to the Broadcasting Act, 1991. The appeal challenged the CRTC’s Broadcasting Regulatory Policy CRTC 2024-121-1, the appended Broadcasting Order CRTC 2024-194, and associated orders made to the individual appellant companies, specifically in connection with the CRTC’s requirement of contributions to the Independent Local News Fund (ILNF). The appeal alleged that the CRTC made legal and jurisdictional errors when it failed to apply recognized principles of statutory interpretation, exceeded its statutory authority by compelling foreign online undertakings to make financial contributions in support of news production, and failed to provide any legal basis or reasoning for imposing the ILNF contribution. This case is ongoing.
