Kumar v McDonald

- Parties: The plaintiffs were Colton Kevin Kumar, 1304139 B.C. Ltd, and Kevin Anthony Kumar. The defendants were John McDonald, Heidi Semkowich, and McDonald Paralegal Services Ltd. 

- Subject Matter: The plaintiffs filed a notice of civil claim alleging that the defendants filed against them a claim making defamatory allegations of unjust enrichment, fraudulent misrepresentation, and operation of an organized pseudolegal commercial argument scam. The defendants sought an order under BC’s Court Jurisdiction and Proceedings Transfer Act, 2003 (CJPTA) to stay the action against them based on the court’s lack of territorial competence over the action. The defendants also requested orders declaring the plaintiffs vexatious litigants and prohibiting them from bringing an action against them without first obtaining leave of the court. 

- Ruling: The court ruled in the defendants’ favour, stayed the action against them for want of jurisdiction, and dismissed the application for an order declaring the individual plaintiffs vexatious litigants and seeking court access restrictions. The court found it appropriate to refuse to exercise territorial competence over the proceeding against the defendants even if it had such competence. To reach this conclusion, the court considered the relevant circumstances in s. 11(2) of the CJPTA, the interests of the parties to the proceeding, and the ends of justice.
