Blake v. Donald

- Parties: The applicant/father was Peter William James Blake. The respondent/mother was Erika Claire Donald. 

- Subject Matter: The parties had a high-conflict relationship and lived two provinces apart. They asked the court to determine the parenting arrangements for their seven-year-old son. The applicant sought an order to vary his parenting time with the child. The respondent acknowledged that they needed a new parenting regime but disagreed with the applicant’s proposed plan. The court had to determine the applicant’s parenting time for the son’s summer break and for every month upon which he did not already have parenting time agreed. The court also had to address the process for the parties to schedule the applicant’s parenting time each year without requiring them to negotiate the dates and times. 

- Ruling: The court ruled in the applicant’s favour and granted his motion to revise the parties’ parenting arrangements for the child. The court noted that the parties agreed to retain numerous original provisions from a final order in 2018. The court’s final order in this case would incorporate these provisions and would follow the standard clauses to the fullest extent possible. The court said that the parties should take all reasonable steps to end the ongoing conflict between them.
